A responsabilidade civil subjetiva de agentes de tratamento de dados pessoais na ótica da Análise Econômica do Direito

O legislador pátrio, ao estabelecer as regras previstas na Lei 13.709/2018, a Lei Geral de Proteção de Dados (LGPD), não explicitou sua opção pela teoria do risco ou da culpa, deixando campo aberto a discussões em relação à modalidade de responsabilidade civil. Seria a responsabilidade por atos de tratamento de dados pessoais objetiva ou subjetiva? Seria necessário avaliar a culpa do agente? Embora estas questões não tenham sido definidas de forma clara, a detida análise do diploma legal permite chegar à conclusão de que a responsabilidade, em regra, deve ser tida como subjetiva, sobretudo quando a interpretação da LGPD recebe suporte do ferramental teórico da Análise Econômica do Direito (AED). A metodologia empregada para o desenvolvimento do presente trabalho foi a pesquisa bibliográfica, por meio do método de pesquisa hipotético-dedutivo.
