Aspectos Concorrenciais do Regime Jurídico e Emergencial Transitório em face da Pandemia de Covid-19

Abstract

Diante da maior crise sanitária do último século, diversas medidas de restrição a livre circulação e ao livre exercício de atividades econômicas têm sido adotadas pelos mais diversos governos, no Brasil e no exterior, a fim de proteger a saúde da população, sob um inegável, ainda que justificável, custo econômico. Como resultado da crise econômica, é possível que agentes detentores do poder econômico adotem condutas oportunistas e anticoncorrenciais com o objetivo de obter ainda maior poder econômico, prejudicando a concorrência, os consumidores e o bem-estar social em geral. Neste contexto, órgãos nacionais e internacionais de defesa da concorrência têm atuado com a finalidade de desincentivar tais condutas, através da adoção de regimes jurídicos transitórios, como por exemplo, a Lei nº 14.010/2020, que instituiu o Regime Jurídico Emergencial e Transitório das relações jurídicas de Direito Privado, objeto de análise do presente artigo, especificamente no tocante aos seus aspectos concorrenciais.
