Intervenções na definição do índice de correção monetária no processo do trabalho: um desincentivo comportamental para composição judicial.

Abstract

As excessivas intervenções na definição do índice de correção monetária no processo do trabalho levam a uma instabilidade na determinação de um respectivo índice, tornando imprevisível não só as matérias deferidas ou indeferidas no processo, mas também qual será a sua repercussão financeira ao final do processo. O artigo objetiva, através do método hipotético-dedutivo, demonstrar quais foram as principais intervenções que ocasionaram e ainda causam a instabilidade e então, a partir dessa demonstração, indicar, com base na economia comportamental, quais as heurísticas e vieses são provocadas pela indefinição e qual a repercussão dessas heurísticas e vieses na solução das lides. Concluiu-se que a indefinição sobre o índice de correção monetária possibilita a ocorrência de heurísticas e vieses comportamentais, instigando as partes do processo a litigarem em busca de um índice de correção monetária mais favorável, mesmo que sem garantias.
