O presente artigo tem como propósito, a partir da observação do fenômeno do Big Data, estabelecer a intersecção entre a proteção de dados com fundamento na livre iniciativa e a regulação desse fenômeno pela legislação antitruste. O estudo analisa a extensão do poder econômico de alguns agentes de mercado, decorrente da captação, processamento, utilização e comercialização de dados pessoais em massa. Conclui-se que tal poderio econômico deve ser alvo tanto da legislação focada na proteção de dados pessoais – LGPD -, como de parâmetros formais e materiais tradicionais do exame antitruste em convergência com os fundamentos da Lei Geral de Proteção de Dados Pessoais.Downloads
