Abstract

The waiver of fees is a possible solution to grant free access to the Judiciary to those who may be unable to pay for it. However, if indistinctively granted, it may lead to frivolous litigation. The present paper explores the Law and Economics of waiver of fees to identify the incentive structure created by litigation gratuitousness and associated social consequences.
