ANÁLISE ECOMÔMICA DA TRAVA BANCÁRIA EM RECUPERAÇÃO JUDICIAL À LUZ DOS DIREITOS DE PROPRIEDADE

Abstract

O presente trabalho busca envolver as tratativas atuais acerca da trava bancária em recuperação judicial, ou seja, os créditos oriundos de contratos bancários com cessão fiduciária de direitos creditícios, com os direitos de propriedade através da ótica da Análise Econômica do Direito, ampliando os estudos sobre o tema, com enfoque nas implicações econômicas oriunda da recente decisão do Supremo Tribunal de Justiça sobre a matéria. Com esta análise, pretende-se dar maior clareza e previsibilidade as regras materiais que devem ser obedecidas pelas empresas que pleiteiam recuperação judicial, onde deve ser levado em consideração as condições para liberar ou não as travas bancárias, equilibrando os interesses entre o credor fiduciário e os envolvidos na recuperação judicial, pautando as ponderações sobre quem será o proprietário de maior valorização e qual a destinação eficiente que dará ao bem garantido. Coadunando o entendimento com as perspectivas de mercado que os agentes possuam, afim de que as partes envolvidas no processo de recuperação judicial possam prever com clareza que atitudes podem ser adotadas com intuito de satisfazer seus interesses e ao entendimento majoritário no ordenamento nacional.
