Evidências Econômicas e Política Antitruste: desafios impostos e saídas institucionais

The article proposes a systemic approach to evaluate the use of economic evidence in antitrust policy. In this sense, one should consider its multidisciplinarity, and legal and institutional apparatuses. The approach adopted in this work consider the use of economic evidence in antitrust with regard to legal and institutional aspects, covering both the general concept of antitrust system and the instruments for reliability and admissibility analysis from the American experience, as the peculiarities arising from economic science. As an illustration case, the work briefly presents the mergers simulations models and key issues for application in the assessment of unilateral effects of mergers. Finally, the conclusion of the article evaluates how the presented criteria and peculiarities are established to define what should be an appropriate assessment of the use of economic evidence, and at the end brings recommendations and institutional solutions to the sources of problems identified along the text.
