ARBITRAGEM COLETIVA NO MERCADO DE CAPITAIS BRASILEIRO E DIREITOS INDIVIDUAIS HOMOGÊNEOS: UMA ABORDAGEM EM DIREITO & ECONOMIA
Abstract
A arbitragem tem tido papel de destaque cada vez maior no ordenamento jurídico brasileiro, com sua capacidade de desafogar um Poder Judiciário defasado e exaurido, além da possibilidade de produzir decisões com maior expertise e sem o risco de recursos infinitos. Nesse sentido, a análise econômica da arbitragem também se mostra como fértil campo de estudo, pois o procedimento é capaz de produzir interessantes externalidades. Da mesma forma, como estratégia para extrair a maior eficiência do procedimento, está a coletivização dos direitos. O presente artigo, portanto, analisa o procedimento arbitral a partir da ótica de sua viabilidade econômica, partindo do estudo de caso das demandas coletivas de direitos individuais homogêneos no mercado de capitais brasileiros, onde a Bolsa de Valores de São Paulo passou a exigir a adesão à clausula compromissária pelas empresas listadas em níveis específicos de governança.Downloads
