A nova cláusula de desempenho e a cláusula de desempenho que o STF não decidiu: fragmentação partidária ou livre participação das minorias?

Abstract

Pelo presente artigo pretende-se analisar os fundamentos utilizados pelo Supremo Tribunal Federal para declarar a inconstitucionalidade das normas que estabeleciam instrumentos considerados cláusula de desempenho para as agremiações partidárias. Avalia-se a conveniência de lege ferenda para fixação de uma nova cláusula de desempenho e os parâmetros de constitucionalidade, tomando como pressuposto a teoria da representação no sistema partidário brasileiro.
