Como a reforma trabalhista impacta litígios judiciais quanto à rescisão do contrato de trabalho? Uma resposta usando teoria dos jogos.

Quando o trabalhador não tem mais interesse em manter vínculo empregatício, o ordenamento jurídico brasileiro estabelece diferentes formas de término do contrato de trabalho resultando em diferenciados benefícios para o empregado e diferentes custos para o empregador. Tais diferenças provocam numerosos litígios, onerando a justiça trabalhista e afetando, negativamente, a produtividade da economia. Entretanto, visando tornar mais célere e responsável o uso daquela instituição, a reforma trabalhista de 2017 introduziu substanciais modificações, como a criação de custos adicionais para o sucumbente no processo judicial e uma nova forma de rescisão do contrato de trabalho. Este artigo analisa como aquelas alterações na lei podem afetar a quantidade daqueles litígios. Para isto, propomos um modelo, baseado em teoria dos jogos, o qual considera algumas modalidades de rescisão existentes. Os resultados obtidos preveem diminuição na possibilidade do surgimento do equilíbrio com processo judicial pós-reforma.Downloads
