Os financiamentos colaborativos, também denominados crowdfuning, vêm sendo uma alternativa para arrecadação de fundos para realização de diversos projetos por aqueles que não possuem condições financeiras de executá-los. A utilização de plataformas digitais como intermediadoras dessa relação entre o interessado em financiar e o financiado é a forma mais comum utilizada, diversas modalidades de financiamento colaborativo podem ser encontradas, porém de forma genérica é possível dividi-los em diretos ou indiretos e em filantrópicos e retributivos. Com base nesta divisão e analisando os principais tributos, o presente estudo busca verificar a incidência do imposto sobre doações (ITCMD) aos sujeitos do financiamento colaborativo direto e indireto, em outras palavras é verificada a incidência do imposto sobre doações (ITCMD) em relação ao financiador, a plataforma digital de financiamento colaborativo e o beneficiário do financiamento.
