A presente pesquisa pretende debater a natureza jurídica da lei do planejamento econômico por regulação, prevista no artigo 174 da Constituição da República Federativa do Brasil. Pretende-se, nesse trabalho, responder à seguinte pergunta-problema: qual a natureza jurídica do planejamento econômico, previsto expressamente na regra constitucional mencionada? Para tanto, pro primeiro, avaliam-se as dificuldades para se estruturar o planejamento econômico por regulação. Por conseguinte, deverá se compreender qual seria a abrangência e a profundidade de sua eficácia jurídica, bem como, como possibilidade de responder à pergunta-problema aqui formulada, poder-se-á compará-la a outras categorias normativas ou à perspectiva estrangeira. O trabalho toma por base o método de abordagem dedutivo, e o método de procedimento fenomenológico. Conclui-se que o planejamento econômico vinculativo ao Estado deve ser compreendido a partir da matriz teórico-dogmática da legalidade administrativa, o que revela que a lei do plano possui prescritividade (consequente jurídico). E quanto ao mercado, dado seu caráter indicativo, a lei do planejamento econômico possui natureza sui generis, aproximando-se a outras categorias jurídicas diagnosticadas na pesquisa.
