Reforma Trabalhista e Rescisão dos Contratos de Trabalho: uma análise à luz da Teoria dos Jogos

A Reforma Trabalhista alterou e inclui vários dispositivos na CLT- Consolidação das Leis Trabalhistas, dentre eles uma nova possibilidade para a extinção dos contratos de trabalho, o comum acordo. Diante da alteração e considerando o fato de que é possível trabalhadores e empresas praticarem fraudes trabalhistas, o presente artigo busca analisar, a partir da Teoria dos Jogos, se empregado e empregador têm incentivos em adotar a nova proposta e se ela contribuiu para reduzir o risco moral induzido pelas fraudes trabalhistas. Para isso, foram feitas suposições e elaboradas várias modelagens: jogo simultâneo entre trabalhador e empresa; jogo sequencial entre ambos; e jogo sequencial entre trabalhador e poder público e empresa e poder público. Os resultados indicam, de modo geral, que trabalhador e empresa ainda possuem alguns incentivos para burlar a legislação e acordar informalmente sobre a extinção do contrato de trabalho, não havendo, por isso, redução do risco moral existente.
