INTELIGÊNCIA ARTIFICIAL E DIREITO EMPRESARIAL: MECANISMOS DE GOVERNANÇA DIGITAL PARA IMPLEMENTAÇÃO E CONFIABILIDADE

A utilização de aparatos das Tecnologias da Comunicação e Informação nos processos empresariais toma pauta no cenário contemporâneo. Ocorre que a fragilidade das pessoas (físicas e jurídicas) diante da insuficiência de conhecimento específico sobre esse ramo pode gerar certa desconfiança e interferir no desenvolvimento do próprio empresário. Assim, o presente artigo tem como problema de pesquisa o seguinte questionamento: como e quais os mecanismos de governança digital podem ser usados para implementação e confiabilidade de técnicas que utilizam inteligência artificial? Para a satisfação da problemática, utiliza-se como base a Ethics Guidelines For Trustworthy AI, de abril de 2019, elaborada pelo grupo de peritos de alto nível sobre a inteligência artificial (GPAN IA), criado pela Comissão Europeia em junho de 2018. O trabalho será dividido em três seções que abordam as modalidades de governança corporativa: 1) o human-in-the-loop (HITL); 2) o human-on-the-loop (HOTL); e 3) o human-in-command (HIC), indicando o seu funcionamento e sua contribuição para com o desenvolvimento das atividades empresariais e sua compatibilidade com o Direito.
