When consolidating the process of redemocratization in Brazil, the 1988 Federal Constitution enshrined gender equity as a fundamental right and guarantee. However, even after more than twenty years of normative validity, in the spaces of juridical power, especially within the scope of the Judiciary and the Public Ministry, such a precept has not become a full reality. This article addresses the possible causes and challenges that the construction of gender equity has been facing precisely in this privileged space for the application of law, as well as the viable routes for the construction of public policies that contemplate the construction of this right of recognition.
