A LEI GERAL DE PROTEÇÃO DE DADOS: OS DADOS PESSOAIS PODEM SER CONSIDERADOS DIREITOS DA PERSONALIDADE?

RESUMO: Este trabalho pretende discutir como a proteção dos dados pessoais deve ser considerada um direito da personalidade. Será abordado como a revolução tecnológica contribuiu para a consolidação de uma sociedade da informação, na qual os dados pessoais adquiriram um papel central e são considerados um dos bens mais valiosos, o “novo petróleo” dos tempos atuais. A seguir, serão tratados alguns aspectos acerca dos direitos da personalidade, como o seu conceito e principais características, para na sequencia analisar o conceito de dados pessoais e concluir se estes podem ser enquadrados como tais. Também se demonstrará que a proteção dos dados pessoais ultrapassa o direito à privacidade, relacionando-se com outros direitos e aspectos da personalidade e da dignidade da pessoa humana.

ABSTRACT: This paper aims to discuss how the protection of personal data should be considered a personality right. It will be discussed how the technological revolution has contributed to the consolidation of an information society, in which personal data have acquired a central role and are considered one of the most valuable assets, the "new petroleum" of nowadays. In the following, some aspects about personality rights, such as their concept and main characteristics, will be treated, in order to analyze the concept of personal data and conclude if they can be classified as a personality right. It will also be demonstrated that the protection of personal data goes beyond the right to privacy, relating to other rights and aspects of the personality and dignity of the human person.
