Resumo
Esta pesquisa tem por objetivo analisar a admissibilidade das provas ilícitas por derivação dentro do processo penal. A discussãodar-se-á, primeiramente, pelo estudo do surgimento da Teoria dos Frutos da Árvore Envenenada pela Suprema Corte Americana e suas mitigações. Serão observados, ainda, os efeitos desta teoria no ordenamento jurídico brasileiro, em especial, o texto do art. 157, do Código de Processo Penal. E, por fim, pretende verificar como o tema está sendo abordado no Projeto do Novo Código de Processo Penal, PL 8045/2010, atualmente em tramite perante o Congresso Nacional.

Abstract/Resumen/Résumé
The purpose of this research is to analyze the admissibility of the derivative evidence within the criminal proceedings. The discussion study will first be about the study of the emergence of the Fruits of the Poisonous Tree Doctrine by the U.S. Supreme Court and its mitigations. It will also review the effects of this theory in the Brazilian legal system, mainly, with respect to the text of art. 157 of the Criminal Procedure Code. And, finally, the study intends to search how the subject has been discussed in the project for the New Code of Criminal Procedure, PL 8045/2010, currently in processing before the National Congress.
