As condenações do insider trading primário e secundário na Comissão de Valores Mobiliários entre 2017 e 2021: uma análise de conteúdo a partir do Iramuteq

Esta pesquisa tem como objetivo responder ao seguinte questionamento: qual é a principal diferença entre processos administrativos sancionadores (PAS) da Comissão de Valores Mobiliários (CVM) que julgam insiders primários e secundários? Para tanto, é necessário atender a quatro objetivos específicos: 1) estabelecer o lugar conceitual do uso de informações privilegiadas; e quem pode ser considerado um insider primário ou secundário; 2) analisar o papel da Comissão de Valores Mobiliários nos Processos Sancionadores; 3) investigar e demonstrar a metodologia da análise de conteúdo como forma de investigação empírica e necessária, bem como a utilização do Iramuteq em estudos jurídicos; 4) apresentar, de modo empírico, se houve diferença entre o conteúdo decisório nas condenações dos insiders primários e secundários, por meio da aplicação da Metodologia de Análise de Decisões (MAD). A abordagem é qualitativa, com base em revisão de literatura e aplicação da Metodologia de Análise de Conteúdo e Análise de Decisões, auxiliada por análise estatística com o software Iramuteq, do studio R. A unidade de análise é Comissão de Valores Mobiliários, e a periodização entre 2017 e 2021. Conclui-se que a maior diferença entre o conteúdo dos votos é a presunção sobre a relevância da informação para o primário, que inexiste para o secundário.
