Abstract

This research builds on Machado e Mattos (2008) to analyze whether interest rates applied by the Judiciary Power to values in dispute could create an arbitrage opportunity when compared to market interest rates. The existence of an arbitrage opportunity could create incentives for the debtor to profligate and litigate instead of settling. Our results support our previous study and show that the practiced interest rate is not an incentive to litigate.
