Abstract

This work aims to examine the existence of a judicial bias in Brazilian courts that favors debtors and the weakest part in contractual relationships. It also aims to verify the existence of judicial insecurity in the State Justice of São Paulo, and if so, which are the variables that affect it. We carry out an accurate analysis of how the Brazilian judiciary system behaves nowadays, and analyze its structures and possible deficiencies that have been increasing the costs to litigate. After a brief theoretical review, we expose and test several hypothesis related to variables affecting the costs of the Justice in the State of São Paulo (TJSP). Preliminary results of this research offer evidences that both judicial bias and judicial insecurity increase litigation costs at Brazilian courts.
