Implicações da Regulação e da Estrutura de Mercado do Serviço de Praticagem na Definição de seus Preços no Brasil

A estrutura de mercado dos serviços de praticagem no Brasil envolve na maioria dos casos um único vendedor (empresa de praticagem) e um pequeno número de compradores (armadores). Por se tratar de uma atividade importante para a segurança da navegação mercantil e por ter uma estrutura de mercado peculiar a atividade é regulada pela Lei 9.537/1997, conhecida como Lei de Segurança do Tráfego Aquaviário (LESTA) e pela NORMAM 12/DPC. O objetivo principal deste artigo é avaliar os impactos do marco regulatório e da estrutura de mercado nos preços do serviço de praticagem no Brasil. Para este fim, propõe um modelo de barganha sequencial finita em que a autoridade marítima é o árbitro do processo. A partir deste modelo é possível concluir que o poder de mercado das empresas de praticagem é inferior ao propagado pela literatura existente, que trata o serviço de praticagem como um monopólio puro e desregulado.
