Análise econômica da regulação no caso da ferrovia “Nova Transnordestina”: proposta de uma agenda de pesquisa para o direito administrativo no Brasil
Abstract
The paper presents the context of the introduction of regulation in the brazilian law and how its reception by the more traditional administrative law dogmatics caused problems for later theoretical developments on the subject. After a literature review on regulation in the economics, a study is carried out on the Nova Transnordestina railroad case, for the purpose of demonstrating that transaction cost analysis can be useful as a tool for understanding the regulation operationalizing, identifying possible problems in regulatory designs, and eventually for proposing alternatives and reforms to improve the adequacy between regulatory goals and legal means to achieve them.Downloads
