Abstract

O Brasil tem características muito peculiares no que concerne à diversificação jurídica que envolve as atividades econômicas, dentre formais e informais. Após a Constituição Federal de 1988 e a orientação da OCDE em 2006, houve um grande salto de inclusão de várias atividades econômicas que saíram da informalidade e alcançaram espaço público de reconhecimento econômico. É o caso da Lei do Microempreendedor Individual. O custo-benefício que decorreu dessa tomada política foi eficiente para os cofres do Poder Público. Para a massa incluída economicamente sobrou recolhimentos fiscais e acesso à Seguridade Social como prêmio pela adesão ao sistema. O problema reside na inclusão social às avessas. A legislação não teve o condão de institucionalizar esses indivíduos para a capacitação cidadã de contribuir efetivamente com o desenvolvimento do país. Para retirar esse véu da norma será necessária a abordagem histórica. Como técnica de pesquisa serão coletados dados de inclusão, os quais serão analisados e enfrentados pela metodologia da Análise Econômica do Direito.
