A Reforma Política sob o Ponto de Vista da Análise Econômica do Direito

Abstract

O texto pretende analisar as consequências e comportamentos que emergem a partir da legislação eleitoral, com foco nas alterações que estão sendo suscitadas no âmbito da reforma política para se tentar reduzir corrupção e práticas antiéticas em geral. Três medidas são examinadas mais a fundo: o financiamento público de campanha, a proibição da reeleição e o voto distrital. Para tanto, será utilizado o instrumental da Análise Econômica do Direito, em especial a teoria econômica do crime, a teoria da escolha racional, a teoria dos jogos e o conceito de seleção adversa. A conclusão a que se chega é que os efeitos da reforma serão minimizados ou atenuados por continuar não havendo mecanismos que desincentivem más práticas ou promovam a renovação política. Se as mudanças não contemplarem instituições mais fortes, corre-se o risco de mudar as regras do jogo sem haver mudança no comportamento dos jogadores
