Abstract

O IMPÉRIO DA LEI COMO FUNDAMENTO DA CIVILIZAÇÃO LIVRE NA PERSPECTIVA DE F. A. HAYEK

RESUMO: O conceito Estado de Direito, ou Império da Lei, é um termo moral normativo que expressa um ideal que a sociedade e suas instituições governamentais devem, como assunto de moralidade política, aspirar. E o intento principal do trabalho de F. A. Hayek, no âmbito da Nova Economia Institucional (NEI), foi recuperar o sentido do termo com base em uma análise histórica e filosófica, a fim de reafirmá-lo. Consoante o Autor, a razão para o declínio atual do Império da Lei é a perversão de instituições ancestrais pela ideologia coletivista do socialismo, e sua promessa de justiça social. Desse modo, a pretensão do presente ensaio é apresentar o conceito de Império da Lei desde as importantes contribuições de Hayek ao debate da Nova Economia Institucional do Século XX, e sua proposta muito particular de sentido ao conceito, inspirada na tradição anglo-saxã, ou programa evolucionário.

Doutorado em Direito pela UFSC - Universidade Federal de Santa Catarina (2016). Pesquisadora da temática "liberdades individuais", na perspectiva do liberalismo anglo-saxão, a partir do marco teórico Friedrich von Hayek. Atua como servidora publica desde 2001, na qualidade de Secretária Jurídica em Gabinete de Desembargador, com experiência em: Direito Público, Direito Comercial, Recursos aos Tribunais Superiores e Processos Administrativos na Presidência do Tribunal de Justiça de Santa Catarina
