Abstract

This article analyzes the applicability of the Economic Analysis of Law in the constitutional jurisdiction in Brazil based on the conceptions of the use of this theory in the judicial decisions of Richard Posner and Ronald Dworkin. Firstly, Posner and Dworkin's conceptions of Economic Law Analysis will be briefly presented. Subsequently, brief considerations will be made regarding the role of constitutional jurisdiction in Brazil, its object and its legitimacy in the Democratic State of Law. Through a bibliographical analysis and using the deductive method, an analysis will be made of the possibility of applying the Economic Analysis of Law in the decisions of difficult cases in the Brazilian constitutional jurisdiction.
