The social function of EIRELI within the contemporary economic background: controversial aspects and economic feasibility

Abstract

It was sought to verify the gaps and dissent left by Law n. 12,441/2011. For this purpose, this article was developed through a qualitative approach, aiming to carry out bibliographic research based on doctrine, specialized journals and legislation. Documentary research and data analysis were also carried out with second-hand documents available on the websites of the Minas Gerais State agencies, in order to contrast the constitution of EIRELIs and individual entrepreneurs. It was verified that there is still doctrinal dissent regarding the characteristics of the institute, but there is a consensus that the value of constitution is too high for certain activities and less developed places, making it difficult to fulfill the institute's social function. For those who have the economic capacity for taking advantage of EIRELI, it was perceived that this option has been widely used in the State of Minas Gerais.
