Efficiency of Courts of Justice in Brazil

This paper discusses the efficiency of Brazilian justice and the evaluation of the National Council of Justice (CNJ) on the State Courts with the use of Data Envelopment Analysis, in light of the constitutional precepts defined by Amendments 19/1998 and 45/2004. Among the various indicators calculated by the Council, the text highlights the Compared Productivity Index of Justice (IPC-Jus) of these courts, in focus given the significant number of units, lawsuits in process, high expense and higher congestion rate of the Brazilian judiciary. The research is applied, uses quantitative approach and qualitative approach, and discusses the calculation model of the IPC-Jus. The results show the need to rethink the inputs and outputs used by the Council, as well as the need to provide new data, especially on the end of the execution of the sentence, so that efficiency can measure the constitutional objectives of the judiciary.
