Determinants of Non-access to Justice in Brazil: some evidence

Abstract

This paper analyzes the main factors of non-access to Justice in Brazil, in particular, institutional ability and financial resources. The first factor involves the comprehension and usage capability to use the system, while the second involves the economic cost of doing it. Pnad/IBGE 2009 data is used in a logit model to measure the non-access to Justice and, more broadly, the non-access to Public Authorities. Results show that institutional ability and financial resources are inverse related to the non-access to Justice, that is, the less educated and less wealthy, the higher probability not to demand both Justice and the Public Authorities.
