Abstract

This article emphasizes cooperation as a tool for the effectiveness of technology transfer agreements, using an Economic Analysis of Law approach. The text is a monographic literature review. From the literature it is possible to conclude that cooperation is important in this kind of contract, since the intangibility of the contracted object points toward uncertainty and lack of safety to the contract closure. In addition, once the technology is shared, it is impossible to return to the pre-contractual situation. Some policies to enhance cooperation, such as legal and fiscal incentives, as well as private measures, are discussed at the end.
