The tax justice model in Brazil, based on a monistic and centralized system, has experienced an eternal crisis. The sterile argument of state authority gives way to the paradigm of the democratic taxation. The taxpayer, as a dignified human being, becomes part of the centrality of law tax. In this perspective, the postulate of the effective judicial protection supersedes the idea of inability of the judiciary, whose statement legitimized the archetype of jurisdiction with an enforceable vocation. The paradigmatic transition from authority to consensus is justified at the heart of the constitutional rule of law, which enshrines broad citizen participation, breaking the proposition of the multiport model, with plural ways for coping with controversies. Tax arbitration in Brazil, pushed by the precursor model of Portuguese law, has been gaining more and more space in the public debate. The current discussion echoes Law Bill No. 4,257, of 2019.

O modelo de justiça tributária no Brasil, pautado em um sistema monista e centralizado, tem experimentado uma crise permanente. O argumento estéril de autoridade estatal cede espaço ao paradigma da tributação democrática. O contribuinte, na condição de ser humano digno, passa a compor a centralidade do direito tributário. Nessa perspectiva, o postulado da tutela jurisdicional efetiva suplanta a ideia de inafastabilidade do poder judiciário, cujo enunciado legitimou o arquétipo de jurisdição com vocação impositiva. A transição paradigmática da autoridade para o consenso encontra justificação no cerne do Estado constitucional de direito, que consagra a participação ampla dos cidadãos, descortinando a proposição do modelo multiportas, com vias plurais para o enfrentamento das controvérsias. A arbitragem tributária no Brasil, impulsionada pelo modelo precursor do direito português, vem conquistando um espaço cada vez mais elastecido no debate público. A discussão atual repercute o Projeto de Lei nº 4.257, de 2019.
