O viés de retrospectiva na economia comportamental: como atenuar seus efeitos na administração tributária

O objetivo deste artigo é sugerir formas de atenuar ou neutralizar os efeitos do hindsight bias, ou viés de retrospectiva, na apuração de tributos. Para tanto, o artigo inicia explicando o que é hindsight bias, um viés de comportamento bastante comum por meio do qual tendemos a supor, no presente, que o resultado de eventos passados era provável, ou mesmo certo, agora que esse resultado é conhecido, embora, no passado, o resultado pudesse ser incerto ou, mesmo, imprevisível. Em seguida, o artigo explica a preocupação doutrinária jurisprudencial com os efeitos do viés de retrospectiva no exterior e as soluções jurisprudenciais adotadas por cortes de vários países. O artigo, então, caracteriza o procedimento de lançamento por homologação como especialmente sujeito aos efeitos do hindsight bias, uma vez que a Fazenda Pública julga o comportamento do contribuinte cinco anos depois que aquela conduta foi adotada. O estudo conclui recomendando, então, a aplicação do artigo 112 do Código Tributário Nacional como um meio, posto insuficiente, de atenuação dos efeitos do viés de retrospectiva, e sugerindo a adoção de duas novas regras para o direito tributário brasileiro, que entendemos mais eficazes na mitigação desses efeitos.Downloads
