RESUMO
Trata o presente artigo de pesquisa acerca da atuação profissional do advogado e a sua proteção constitucional. O estudo também destaca o papel do advogado parecerista nas contratações públicas, os limites de sua atuação e a natureza jurídica do parecer emitido por ele em processos licitatórios. A pesquisa contempla a diferenciação entre os atos de gestão pública e a atuação do advogado parecerista nas contratações públicas. O estudo apresenta os aspectos técnicos da decisão paradigmática proferida pelo Supremo Tribunal Federal por ocasião do julgamento do Mandado de Segurança nº. 24.631-6/DF; analisando o dolo, a má-fé e o erro grave, como elementos fundantes da responsabilização por atos ímprobos. Também investigou-se a boa-fé objetiva como elemento estruturante e inicial de todos os atos administrativos. A pesquisa findou abordando as recentes decisões judiciais que dão sustentação à reconsideração acerca da responsabilidade do administrador público e do advogado parecerista, que excluem o erro como hipótese do fundamento punitivo pela Lei de Improbidade Administrativa. O presente artigo foi edificado mediante a utilização do marco metodológico dedutivo, valendo-se como premissa maior a Constituição Federal e a definição da imunidade do exercício profissional da advocacia, verificando-se as exceções nas normas infraconstitucionais, com destaque para a aplicação da Lei de Improbidade Administrativa. A finalidade da pesquisa foi de obter resposta ao seguinte questionamento: quando o advogado público pode ser responsabilizado por ato de improbidade administrativa pela emissão de parecer jurídico?

ABSTRACT
This research article deals with the professional performance of the lawyer and its constitutional protection. The study also highlights the role of the legal counsel in public procurement, the limits of his practice and the legal nature of the opinion issued by him in bidding processes. The research contemplates the differentiation between the acts of public management and the role of the legal adviser in public contracts. The study presents the technical aspects of the paradigmatic decision handed down by the Supreme Federal Court when the writ of mandamus no. 24.631-6 / DF; analyzing deceit, bad faith and serious error, as founding elements of accountability for unjust acts. Objective good faith was also investigated as a structuring and initial element of all administrative acts. The research ended by addressing the recent judicial decisions that support the reconsideration about the responsibility of the public manager and the legal adviser, who exclude the error as a hypothesis of the punitive foundation by the Administrative Improbity Law. This article was built using the deductive methodological framework, using the Federal Constitution and the definition of immunity from the professional practice of law as a major premise, checking the exceptions in the infraconstitutional rules, with emphasis on the application of the Law of Administrative dishonesty. The purpose of the research was to obtain an answer to the following question: when can the public lawyer be held responsible for an act of administrative improbity for issuing a legal opinion?
