A EFICÁCIA DO COMPLIANCE PÚBLICO/PRIVADO NO COMBATE À CORRUPÇÃO

RESUMO
Objetivo: O presente artigo conceitua o compliance e aborda o mal que a corrupção causa nas organizações e na sociedade; as estratégias utilizadas pelo compliance para minimizar os riscos e impactos que a corrupção causa para as organizações, governo e sociedade civil; bem como as metodologias aplicadas para a implementação de uma estrutura de compliance e principalmente os seus limitadores.
Metodologia: O método de abordagem utilizado é o hipotético dedutivo, partindo do geral para o particular, por meio de raciocínio em doutrina e legislação, com o objetivo de chegar a uma conclusão. Quanto às técnicas de pesquisa, utilizam-se leituras e consultas em obras, artigos científicos e legislação doméstica e de direito comparado.
Resultados: O Estado é o maior responsável por manter o próprio Estado livre da corrupção. Quando a estrutura de um País é bem organizada política e socialmente, com educação de qualidade, leis rígidas e eficazes, com um poder de polícia eficiente e respeitado pela nação, bem como um controle social efetivo e atuante, tem-se instrumentos eficazes no combate aos abusos de poder, desigualdades e pobreza, contribuindo sobremaneira para o extermínio da corrupção ou pelo menos para coibi-la. Os programas de compliance ou integridade estão sendo instituídos em todo o País, tanto na esfera pública quanto na privada. Há disseminação de uma cultura onde os desvios e a corrupção não são mais tolerados. Os preceitos quanto à postura esperada de todos os cidadãos é o que está refletido nos códigos de ética e de conduta espalhados pelo Brasil. O compliance tem um papel fundamental na educação e disseminação desta cultura. O monitoramento e a aplicação de sanções pelo descumprimento fazem parte do processo educativo e não podem estar separados de um bom programa de integridade.
Contribuições: A presente pesquisa tem por maior contribuição despertar o leitor para a verdadeira essência do compliance e estimular atitudes de mudanças, principalmente na formação de um indivíduo com espírito de integridade e conformidade.

ABSTRACT
Objective: This article conceptualizes compliance and addresses the harm that corruption causes in organizations and society; the strategies used by compliance to minimize the risks and impacts that corruption causes for organizations, government and civil society; as well as the methodologies applied for the implementation of a compliance structure and mainly its limitations.
Methodology: The method of approach used is the hypothetical deductive, starting from the general to the particular through, reasoning in doctrine and legislation, with the objective of reaching a conclusion. As for research techniques, readings and consultations are used in books, scientific articles and domestic and comparative legislation.
Results: The State is the most responsible for keeping the State itself free from corruption.When the structure of a country is politically and socially well organized, with quality education, strict and effective laws, an efficient police power respected by the nation, as well as effective and active social control, it has effective instruments to combat abuses of power, inequalities and poverty, contributing greatly to the extermination of corruption or at least to curb it.. Compliance or integrity programs are being implemented across the country, both in the public and private spheres. A culture is spreading where deviations and corruption are no longer tolerated. The precepts regarding the expected posture of all citizens are reflected in the codes of ethics and conduct throughout Brazil. Compliance plays a fundamental role in the education and dissemination of this culture. Monitoring and applying sanctions for non-compliance are part of the educational process and cannot be separated from a good integrity program.
Contributions: The main contribution of this research is to awaken the reader to the true essence of compliance and to stimulate attitudes of change, especially in the formation of an individual with a spirit of integrity and conformity.
