EL ARBITRAJE EN MATERIA TRIBUTARIA EN ESPAÑA: VIABILIDAD DE SU IMPLEMENTACIÓN

En España se viene planteando desde hace más de quince años y desde diferentes sectores (doctrinales, empresariales y profesionales), la posibilidad de introducir el arbitraje como método de resolución de conflictos surgidos entre la Administración y los obligados tributarios. No obstante, y pese a la existencia de numerosas y variadas propuestas de implementación de dicha técnica en el ámbito tributario, lo cierto es que a día de hoy nos seguimos encontrando ante una mera posibilidad, ya que nuestro legislador se ha mantenido reticente en todo momento a su introducción en el ordenamiento tributario español.
Aún cuando a lo largo de los últimos años se han efectuado algunas reformas normativas con el objetivo de mejorar los índices de conflictividad existentes en este ámbito, se trata de medidas puntuales que ha quedado demostrado no han producido el efecto deseado, esto es, evitar o reducir, en la medida de lo posible, la elevada litigiosidad existente en materia tributaria en España.
