SEGURANÇA ENERGÉTICA E REGIMES JURÍDICOS REGULATÓRIOS NO SEGMENTO DE E&P DO SETOR DE HIDROCARBONETOS

O objetivo do presente artigo é analisar os regimes jurídicos regulatórios vigentes hodiernamente no segmento de E&P do setor de hidrocarbonetos no país, quais sejam, aquele introduzido pela Emenda Constitucional Nº 09/1995 e o novo regime apresentado quando da descoberta do pré-sal, trazido pelas Leis Nº 12.351/2010, 12.304/2010 e 12.276/2010. A principal tese pugnada aqui milita em favor da mantença simultânea dos dois regimes jurídicos exploratórios. Essa tese é defendida sob o argumento de que a mantença dos dois regimes permite ao Estado hospedeiro maior flexibilidade tanto para operar em áreas de altos ou baixos riscos exploratórios, quanto para ajustar sua política energética a esse recurso natural finito que ora se comporta como commodity, ora como recurso estratégico, tudo isso sob sob o crivo de garantir segurança energética para o país, bem como fomentar, através desse recurso estratégico, sua política industrial.
