Patentes: justificativas econômicas e seus efeitos sobre a inovação

RESUMO
O presente artigo busca compreender as justificativas econômicas para a existência das patentes, e se elas possuem uma influência positiva sobre as inovações de produto e processo realizadas pelas empresas. Para tanto, através de revisão de literatura, investiga-se a hipótese de que as patentes são um estímulo às inovações ao funcionarem como mecanismo de apropriabilidade dos frutos do progresso técnico. A perspectiva da concorrência schumpeteriana considera que as empresas inovam para adquirir vantagens competitivas, se diferenciar dos competidores e alcançar lucros extraordinários em um ambiente de constante mutação. Nesse sentido, as patentes, ao propiciarem o monopólio temporário sobre uma inovação, geram um fluxo de lucros extraordinários que permite à empresa recuperar seus gastos em P&D e funciona como incentivo à inovação. Contudo, há argumentos que contrapõem essa hipótese e afirmam que as patentes podem dificultar a inovação e que ambientes competitivos podem ser mais favoráveis. Diante disso, o presente trabalho faz uma breve revisão bibliográfica a respeito das inovações e das patentes para então avaliar os argumentos teóricos favoráveis e contrários à hipótese de que elas são benéficas para as inovações. Conclui-se que a interação entre os direitos de propriedade e as inovações variam de acordo com os setores da indústria analisados e as estratégias da empresa em sua gestão de direitos de propriedade, por vezes contribuindo para as inovações e por vezes a obstaculizando.
