ENFRENTAMENTO DA DEMANDA E DO ACERVO PROCESSUAL CONFORME A COMPLEXIDADE DA CAUSA NO PRIMEIRO GRAU DE JURISDIÇÃO

O objetivo do presente texto é discorrer sobre medidas para o enfrentamento da demanda e do acervo processual, no primeiro grau de jurisdição, de acordo com o grau de complexidade de cada causa. A justificativa para esta pesquisa reside no considerável volume de ações judiciais periodicamente submetidas ao crivo do Poder Judiciário. As conclusões foram no sentido de que considerável parcela do estoque processual é composta pelas chamadas demandas de baixa intensidade/complexidade ou repetitivas, as quais tendem a congestionar a dinâmica de trabalho e, consequentemente, dificultar a disponibilização de tempo e recursos para o adequado tratamento das causas de alta intensidade/complexidade. Para enfrentar a demanda excessiva e o acervo acumulado foram propostas as medidas consistentes em triagem complexa, distribuição equilibrada da força de trabalho judicial, segunda camada de competências, equalização da demanda, criação de regiões metropolitanas, programa temporário para enfrentamento do acervo e equalização dos custos do sistema. Quanto à metodologia empregada, destaca-se que na fase de investigação foi utilizado o método indutivo, na fase de tratamento de dados o cartesiano e o texto final foi composto na base lógica dedutiva. Nas diversas fases da pesquisa, foram acionadas as técnicas do referente, da categoria, do conceito operacional e da pesquisa bibliográfica.Downloads
