A regulação pública do Uber é necessária? Um argumento pragmatista para além do “tû-tû”
Abstract
Muito se tem discutido a respeito do tratamento jurídico dos serviços de intermediação do transporte individual de passageiros, pautados em tecnologias inovadoras. A doutrina jurídica tem empreendido esforços de classificar esse tipo de atividade dentro das categorias do direito público: serviço público, atividade econômica, serviços de interesse econômico geral, e assim por diante. Partindo da matriz teórica pragmática, pautada no antifundacionalismo, no contextualismo e no consequencialismo, constata-se que uma abordagem mais produtiva do problema pode ser obtida a partir dos critérios regulatórios da atividade. Com base em tais premissas, pretende-se verificar se e em que medida a regulação pública do Uber é necessária, de modo a ser eficiente e orientada à satisfação dos consumidores, sem que isso inviabilize os diferenciais atrativos da atividade, propiciados pelas novas tecnologias.Downloads
