Abstract

The present article tries to elucidate concepts related to disinformation and the efforts to combat it through fact-checking agencies, taking as a basis for discussion the sanctioning of Bill 14.197/2021, in particular Art. 359-O, which tries to give criminal characteristics to the practice of "misleading mass communication". This article aims, through theoretical relations between published scientific material, to present inconsistencies in the definitions offered by parliamentarians and the President of the Republic regarding the elements that make up the discussion on the impacts of disinformation upon brazilian democracy, in order to clarify existing theoretical contradictions.
