LEGAL ANALYSIS AND INTERPRETATIONS OF THE JURISDICTIONAL PROTECTION WITHIN THE SINGLE RESOLUTION MECHANISM

Abstract

The aim of this research is therefore to present the first reflections on the accountability level in the Single Resolution Mechanism field, that is to say the possibility of controlling the work of a "technical" subject (SRB and NRAs), by "non tecnical" subjects, or the competent judicial authorities. These reflections, given the lack of rulings by the european judge on the matter, will be formulated starting from the analysis of the relevant legislation, in order to verify whether the effective respect of fundamental rights, as well as rights, freedoms and principles recognized by the Charter of Fundamental Rights of the European Union can be said to be guaranteed.
