DIREITOS AUTORAIS NO BLOCKCHAIN: ESCASSEZ COMO INCENTIVO PARA PRODUÇÃO OU CONCENTRAÇÃO DE RIQUEZA?

Abstract

A propriedade privada é um incentivo essencial para a geração de riqueza e preserva uma necessária proporção de escassez dos recursos. Embora isso seja verdade para bens tangíveis, no contexto de bens intangíveis, especialmente produtos digitais, a escassez é praticamente inexistente diante da possibilidade de copiar e replicar a um custo marginal muito baixo. Neste cenário, não apenas o valor monetário é significativamente reduzido, como também a atribuição de autoria é dificultada, prejudicando a remuneração dos autores.A tecnologia blockchain pode redefinir a tutela da propriedade intelectual. O capítulo analisa este novo ambiente de negócios, no qual a proteção dos direitos de propriedade pode ser um incentivo para a produtividade e desenvolvimento econômico, ou então, uma forma de concentração de riqueza e de restrição do acesso a cultura e informação.
