Ainda não há legislação em vigor no Brasil (ou normativas administrativas) concernente ao risco que as nanopartículas possam vir a representar para o meio ambiente e para a saúde humana. Nesta senda, o problema do qual este trabalho se ocupa é: que dispositivos normativos presentes na programação jurídica brasileira podem ser considerados importantes para o empreendedor levar em consideração no momento de investir em nanotecnologia no Brasil? A hipótese apresentada é a de que o princípio da precaução é fator a ser levado em consideração. Aliás, considera-lo como importante faz com que diversas medidas devam ser tomadas pelo empresário que se interesse por investir em nanotecnologias – inversão do ônus da prova em seu desfavor em eventuais processos por responsabilidade civil talvez seja a principal delas. O objetivo geral deste trabalho é descrever a presença do princípio da precaução no ordenamento jurídico brasileiro. Para a consecução deste objetivo geral, dividiu-se o artigo em dois objetivos específicos: a) analisar-se-ão as principais características e previsões normativas do referido princípio na legislação brasileira; b) será descrita a jurisprudência do Superior Tribunal de Justiça, no que tange a tal principiologia, descrição esta que se direcionará àquilo que importa para o empreendedor: o que significa a inserção do princípio da precaução na normatização das nanotecnologias, a fim de se analisar que reflexos na atividade econômica tal princípio pode apresentar.
