Abstract

Judicial independence is considered an extremely important characteristic of the Judicial Branch. In Brazil, several institutes were established in order to assure formal judicial independence. However, there is the possibility that the nomination procedure for Brazil’s Supreme Court may allow interference from the Executive and Legislative Branch over this Court’s decisions. The present study intends to make an empirical verification concerning this method of choice, through the analysis of the court members’ votes in several cases. The results show that the method used does not jeopardizes the decisions of Brazil’s Supreme Court.
