Resumen

The essay intends to demonstrate that freedom to contract and of contract shall be observed even in consumer contracts and that judicial intervention shall be restricted to when Law specifically allows and commands courts to intervene. Even in such cases, judicial interference shall happen in a prudential and restrictive manner, with a great degree of deference to parties’ will. The analysis will go beyond strict legal reasoning and will demonstrate that non-interference or limited court interference in contracts will produce better results for the consumer.
