Princípio do Tratamento Nacional ao acordo geral de tarifas e comércio e a isenção de ICMS ao peixe brasileiro: análise da controversa aplicação

A pesquisa expõe, para uma melhor compreensão do tema, aspectos relevantes sobre o nascimento do Acordo Geral de Tarifas e Comercio (General Agreement on Tariffs and Trade – GATT) e da Organização Mundial do Comércio (OMC) de forma analítica, com alguns dos pontos controversos de sua aplicação. Inúmeras discussões ocorreram no âmbito de Tribunais brasileiros, pois buscava-se a compreensão sobre a natureza e o tratamento tributário do bacalhau da Noruega, tendo em vista a tributação do peixe seco e salgado do Brasil, analisando uma possível similaridade entre os produtos em tese. O objetivo geral é demonstrar que as conclusões do judiciário pátrio restaram-se equivocadas, em dissonância com o real significado do termo e com os padrões de reconhecimento de like product da OMC. Neste sentido, a metodologia utilizada foi a exploratória, que destinou-se a garantir uma análise do conceito da similaridade do GATT; utilizou-se uma abordagem qualitativa voltada a aprofundar e compreender o debate sobre o assunto. A pesquisa é descritiva e exploratória, visto que conceitua, explica, descreve, interpreta, inova, discute e esclarece os fatos. Percebe-se também que as críticas dos países são coerentes ao referido acordo, uma vez que ignora-se as necessidades de todos os signatários, podendo prejudicá-los no seu mercado interno e externo. Concluiu-se, após a análise do conceito de similaridade, que o bacalhau e o peixe brasileiro não são produtos similares.
