Abstract

This article explores the challenges the Brazilian Rule of Law grapples with in the digital context, particularly under surveillance capitalism. It underscores the necessity of an interdisciplinary approach in understanding and confronting disinformation and online manipulation, as evidenced by Elon Musk's actions against the Federal Supreme Court. The analysis also highlights the limitations of traditional legal responses in the face of the economic power of Big Techs and the spread of misinformation. It advocates for a review of the Theory of Institutional Dialogues, a reformulation of Law courses, and a focus on the materiality of social relations and the interaction between the various interpreters of the Constitution as the main legal sources.
