Abstract

The text invites the reader to reflect on the fundamental issues currently in crisis within the criminal justice system, with a particular focus on criminal procedural matters. After identifying these elements (the persistence of an essentially inquisitorial procedural system, the mere importation of restorative justice elements, the excessive simplification of criminal processes, and the necessary redefinition of criminal procedural action), the text endeavors to provide elements for an initial discussion on the contours and limits that must be observed to align this justice system with democratic and republican constitutional values. Consequently, it examines to what extent the due process of law would be defined.
